Terms and Conditions<\/h2>\n\n\n\n
Itametrix is a Cybersecurity performance solution delivered as a managed service for helping customers to make right decisions and efforts to Effectively Protect their Business Outcomes. The service is provided by Exypnos -or your selected Partner- and it’s powered by Itametrix, a Microsoft PowerPlatform App. The service is delivered to you according the plan selected and requires at least one Power BI Pro license for each authorized user. <\/p>\n\n\n\n

By using our service, we provide you with a non-exclusive Itametrix license while the service is enabled. By accepting the service you accept the terms and conditions established.<\/p>\n\n\n\n

Purpose and Service Provision:<\/h2>\n\n\n\n

These terms regulate the provision of services by Exypnos and the payment thereof by the Client. The services to be provided by Exypnos are detailed in “Scope of services”<\/p>\n\n\n\n
In the provision of its services, Exypnos will act with diligence and a competent work team to comply with the obligations described and other applicable laws<\/p>\n\n\n\n
For its part, the Client undertakes to provide Exypnos with all the information necessary for the correct development of its work. Likewise, the Client undertakes to pay in a timely manner the services provided by Exypnos<\/p>\n\n\n\n
The total service will be billed according to the selected plan and the corresponding law taxes will be added<\/p>\n<\/blockquote>\n\n\n\n

Responsibility:<\/h2>\n\n\n\n

Exypnos undertakes to hold the client harmless in relation to any loss, damage or expense that may be suffered and that is caused by Exypnos as a result of a serious or intentional negligent action in the provision of its services. The compensation will be limited to a maximum amount equivalent to the last 3 months of invoicing<\/li>\n<\/ul>\n\n\n\n

Data Protection:<\/h2>\n\n\n\n

Exypnos complies with personal data protection regulations, the access that Exypnos has to your data is used solely and exclusively to serve the purpose of the service<\/p>\n\n\n\n
In the event that, during the contractual relationship, the Client provides Exypnos with personal data of employees or third parties, the Client, as responsible for said data, must have informed them, in advance, of the processing of their personal data, of the purpose thereof, and have obtained their consent from the holders.<\/p>\n\n\n\n
The Client is informed that all the holders of the data that, eventually, may be provided to Exypnos may exercise the right of access, rectification, deletion, limitation, and opposition by sending an email to the address data@exypnos.co accompanied by an identity document<\/p>\n<\/blockquote>\n\n\n\n

Timing<\/h2>\n\n\n\n

Once the contract has ended and if there is no renewal, Exypnos will end the provision of the service and will proceed to securely delete all personal data and \/ or business information held by the client<\/li>\n<\/ul>\n\n\n\n

Itametrix Service Usage:<\/h2>\n\n\n\n

These terms regulate the use of the Itametrix solution as well as the licensing conditions thereof<\/p>\n\n\n\n
Exypnos is committed to providing the Itametrix solution on Microsoft Power Platform for which customer requires a Power BI Professional license<\/p>\n\n\n\n
Exypnos will provide the appropriate training for the correct use of the functions and will be made available for minor adjustments and customizations of each Client<\/p>\n\n\n\n
The Customer undertakes to pay for the service included in the Itametrix solution under the Software-as-a-Service (SaaS) model with the payment of which the Customer becomes a licensed user<\/p>\n\n\n\n
The Client acknowledges Exypnos as the owner of the Intellectual Property (IP) rights over its business model and the Itametrix solution and undertakes not to disclose to third parties\u2019 information specific to the solution<\/p>\n\n\n\n
For the development of Itametrix, Exypnos signed an agreement with Microsoft Corporation. The customer is aware of the existence of the agreement and undertakes to respect the terms and conditions of Microsoft as a Platform Provider<\/p>\n\n\n\n
Exypnos is associated into the Microsoft Cloud Partner Program. This association helps Microsoft understand the ecosystem of IT service providers and to refine the tools and programs needed to best support the customers. The customer accept to link their Microsoft subscription or agreement with our PartnerID to help Microsoft recognize our value delivered.<\/p>\n\n\n\n
The license of use is not exclusive, nor transferable to third parties. The use of reverse engineering or similar technologies is prohibited<\/p>\n\n\n\n
Failure to comply with any of the obligations will give rise to a claim by Exypnos for damages caused to it.<\/p>\n<\/blockquote>\n\n\n\n

Competitors<\/h2>\n\n\n\n
If you are in the business of providing services such as Cybersecurity Assessment or similar Services for the purpose of providing them to companies for a commercial gain, then you are a competitor of Exypnos. Competitors are not permitted to use or access any information or content on our Application. If you breach this provision, Exypnos will hold you fully responsible for any loss that we may sustain and hold you accountable for all profits that you might make from such a breach.<\/p>\n\n\n\n
